TERMS OF SERVICE – #GETLASHED

Introduction

Ojurire NG (the “Company”) is a Business name duly registered under the laws of the Federal Republic of Nigeria and trades under the name LashedByOjurire which is a beauty spa. It offers a comprehensive collection of beauty treatments and services tailored to its esteemed clients including Eye Lash, Eyebrows, Body sculpting, Ear Candling and sale of beauty products.

 

The Company created the #GetLashed campaign for the purpose of empowering youths who are passionate about developing their skills in lash art through free training and mentorship for a period of six (6) months.

 

The Company acts as the data controller for personal data processed in respect of the services rendered and for the #GetLashed campaign. The Company shall be referred to as “we”, “our” or “us” as the context would permit.

 

This page explains the terms by which you may use our online channel to apply for the GetLashed training program (the Service). By using the Service, creating an account and checking the “I agree” (or similar) box, or otherwise accessing or using the Service, you (1) confirm that you have read, understood, and agree to be bound by the terms and conditions of these Terms of Service (these “Terms”), and (2) that you have read and acknowledge the collection and use of your information as set forth in our Privacy Policy, whether or not you are a registered user of the Service.

These Terms apply to all visitors, customers/clients and others who access the Service (“user”, “you,” or “your”).

PLEASE READ THESE TERMS CAREFULLY AND BE SURE YOU FULLY UNDERSTAND, BECAUSE IT EXPLAINS AND CONTROLS YOUR LEGAL RELATIONSHIP WITH US AND YOUR RIGHTS AS THEY RELATE TO YOUR USE OF THE SERVICE. UPON YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS, THIS BECOMES A BINDING CONTRACT BETWEEN YOU AND US

Eligibility

You may use the Service only if you can form a binding contract under the Nigerian law, and only in compliance with these Terms. Any use or access to the Service by anyone under 16 years of age is strictly prohibited and in violation of these Terms. The Service is not available to any User previously removed from the Service by LashedByOjurire.

Notifications and Emails

By providing us with your email address, you consent to being notified of our Service-related notices, and other messages, such as changes to features of the Service and special offers (“Newsletters”). We may provide other notifications, whether such notifications are required by law or are for marketing or other business related purposes, to you via email, “push” mobile notifications. We reserve the right to determine the form and means of providing notifications to our Users. We are not responsible for any automatic filtering that you or your network provider may apply to email notifications we send to the email address you provide to us. You can manage your email and notifications preferences on your account settings page. In the case of any newsletter or other marketing initiatives, you can withdraw your consent to receiving those communications and unsubscribe to those communications at any time by clicking “Unsubscribe” at the bottom of such communication. Doing so may have a material impact on our ability to provide the Services to you and we are not responsible if you do so.

Our Proprietary Rights

In these Terms, “Intellectual Property Rights” means all patent rights, copyright, mask work rights, moral rights, rights of publicity, trademark, goodwill, trade secret rights and other intellectual property rights as may not exist or hereafter come into existence, and all applications therefore and registrations, renewals and extensions thereof, under the laws of any nation, state, province, territory or other jurisdiction. The Services and all materials herein or transferred hereby, including, without limitation, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, video and music, and belong to LashedByOjurire, other Users, and other licensors to Ojurire NG and all Intellectual Property Rights related thereto. Use of the website content or the Service for any purpose not expressly permitted by these Terms is strictly prohibited.

Feedback

You may choose to or we may invite you to submit comments or ideas about the Services, including without limitation about how to improve the Services or our products (“Ideas”). By submitting any Idea, you agree that your disclosure is gratuitous, voluntary, and without restriction and will not place the Company under any fiduciary or other obligation, and that we are free to use the Idea without any attribution or additional compensation to you, and/or to disclose the Idea on a non-confidential basis or otherwise to anyone. You further acknowledge that, by acceptance of your submission, the Company does not waive any rights to use similar or related ideas previously known to, or developed by its employees, or obtained from sources other than you.

Security

The Company cares about the integrity and security of your personal information. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your personal information for improper purposes. You acknowledge that you provide your personal information at your own risk. You are fully responsible for all interaction with the Services that occurs in connection with your registration/application information. You agree to immediately notify us of any unauthorized use of your registration information or any other breach of security related to your account or the Services, and to ensure that you “log off”/exit from your account with the Services (if applicable) at the end of each session.

We are not liable for any loss or damage arising from your failure to comply with any of the foregoing obligations. If you sign into the Service using a third-party social networking platform account, be sure to review the privacy and data usage policies of such platform to learn more about its personal information practices and your options, as they may differ from those governed by our Privacy Policy and these Terms.

Amendment

We may revise and update these Terms from time to time. You are responsible for regularly reviewing these Terms to obtain timely notice of such updates. To the extent permitted by law, all changes are effective immediately unless we indicate a different effective date when we post them. Notwithstanding the foregoing, any changes to these Terms will not apply to any dispute between you and us which may have arisen prior to the date on which we posted the revised version of these Terms incorporating such changes or otherwise notified you of such changes.

Entire Agreement

These Terms and Conditions, together with any offer letter or any documentation, we issue to you, constitute the entire agreement between us, and you acknowledge that you shall not rely upon any representations, statements or pre-contractual statements that are not expressly set out in these terms.

Third-Party Rights

Subject to the foregoing, this Agreement does not confer any rights on any person or party (other than the parties to this agreement).

Communications and Notices

Any notice given by any party under or in connection with these terms shall be in writing and in English and shall be sent by the relevant party for the attention of the contact and to the address as notified by the party, from time to time. It shall be delivered by email, or sent by pre-paid post, and shall be deemed received as set out below.

  • Delivery of a notice is deemed to have taken effect provided that all other requirements in this clause have been satisfied, if delivered by email, upon sending; or if sent by pre-paid post, or special delivery to an address in Nigeria, on the second business day after posting.

 

  • To prove successful delivery, it is sufficient to show that the message was sent to the correct email address, (lashedbyojurire@gmail.com or in person at the Company’s office. Or the email address associated with your account), and if delivered by post, the envelope containing the notice or other communication was properly addressed, paid for and posted.

 

Survival

All disclaimers, indemnities and exclusions in these terms shall survive termination of these terms for any reason, as shall any other provisions of these terms that by their nature are intended to survive such termination.

No Waiver

No failure or delay by you or us in exercising any of our rights under these terms shall be deemed to be a waiver of that right, and no waiver by you or us of a breach of any provision of these terms shall be deemed to be a waiver of any subsequent breach of the same or any other provision.

Severability

If any provision of these Terms and Conditions is held by any court or other competent authority to be invalid or unenforceable, in whole or in part, these Terms and Conditions shall continue to be valid as to its other provisions and the remainder of the affected provision.

No Partnership

These Terms and Conditions shall not be construed so as to create a partnership or joint venture between you and us. Nothing in these Terms and Conditions shall be construed so as to constitute you and us as agents of one another. All rights and obligations as contained in common law, statute or equity shall apply unless otherwise stated in this Agreement.

Assignment

These Terms and Conditions shall be binding on and inure to the benefit of each party. No party (other than Ojurire NG) shall assign or sub-contract any of its rights or obligations under these terms (in whole or in part) without the prior written consent of Ojurire NG. Ojurire NG shall be entitled to assign or sub-contract any of its rights or obligations under these Terms and Conditions in whole or in part.

Governing Law and Jurisdiction

Subject to any other provision in any other documents shared with you, these Terms and Conditions (and any dispute or claim relating to it or its subject matter (including non-contractual claims) is governed by and is to be construed in accordance with Laws of the Federal Republic of Nigeria. The parties irrevocably agree that any dispute (including non-contractual claims) which may arise out of or in connection with these Terms and Conditions shall be referred to the Lagos Multi-Door Court and settled by a single mediator and the sit of hearing shall be Lagos State, Nigeria. The language of the mediation shall be English language.

Waiver

A provision of or a right created under these Terms and Conditions may not be

  • waived except in a writing executed by both parties; or
  • varied except in a writing duly executed by both parties.

No waiver shall be deemed a waiver of any preceding or succeeding breach or right in the same or in any other provision hereof.

Your representations and warranties

You represent and warrant that:

(i)   The information given to us via LashedByOjurire application portal, email or other electronic medium or in other form of writing as well as documents uploaded or scanned to us in support of the GetLashed Campaign application are true, accurate and complete. You are solely responsible for the correctness of such information. We shall not be liable for relying on any documentation provided by you and also accept no liability for consequences arising out of any erroneous, incorrect or incomplete information supplied by you. If you suspect that there is an error in the information you have provided to the Company, you shall advise the Company accordingly without delay. The Company will endeavour to correct the error whenever and wherever possible on a ‘best effort’ basis but shall have no liability arising therefrom.

(ii)  In the event your personal information, including phone number and address, changes you are required to inform the Company of such change.

(iii) Under no circumstance will we be liable for any loss, expense or damage of any kind incurred by you due to non-compliance with these requirements.

In respect of personal data processed in connection with this Agreement, the Company shall act only in accordance with the provisions of the relevant data protection regulations in force in Nigeria, regarding the processing of your personal data, and ensure that appropriate technical and organisational measures shall be taken against unauthorised or unlawful processing of your personal information.
